Estate Planning Services

Estate planning is more than deciding who receives your property. It’s about establishing clear instructions, protecting your assets and making important decisions before they become urgent.

Kim Welch Law provides a range of estate planning services, from simple wills and powers of attorney to more comprehensive trusts and asset protection arrangements.

Wills and Estate Planning

A will is a foundational estate planning document that outlines how you want your property distributed after your death. Depending on your circumstances, it may also allow you to nominate guardians for minor children and identify the person responsible for administering your estate.

Whether you’re creating your first will or updating an existing document, Kim Welch Law can help you establish written instructions that reflect your wishes.

Available Services:

  • Simple Wills
  • Mirror Wills for Couples and Families
  • Wills with Powers of Attorney

Trusts and Asset Protection

Trusts can provide additional flexibility and control over how assets are managed and distributed. Depending on the type of trust and how it is established, a trust may help avoid probate for assets properly transferred into it, provide for beneficiaries and establish instructions for long-term asset management.

Asset protection planning focuses on organizing and protecting assets through appropriate legal arrangements. The options available depend on your financial circumstances, goals and applicable laws.

Available Services:

  • Simple Trusts with Wills
  • Complex Trusts with Wills
  • Asset Protection Trust and Will Packages
  • Comprehensive Estate Planning Arrangements

Powers of Attorney

A power of attorney allows you to designate someone to make certain decisions on your behalf under circumstances defined in the document.

These documents can be especially important if an illness, injury or unexpected event leaves you unable to manage your own affairs.

Kim Welch Law offers:

  • General Power of Attorney: Authorizes a designated person to handle specified financial or legal matters.
  • Durable Power of Attorney for Healthcare: Provides authority for designated healthcare decisions under applicable law.
  • Power of Attorney Bundle: Combines available documents for more comprehensive planning.

The initial consultation provides an opportunity to discuss your needs and determine which services may be appropriate for your situation.

When Should You Create or Update Your Estate Plan?

Estate planning isn’t something you need to put off until retirement. Major life changes can affect how you want your assets managed and distributed.

You may want to create or review your estate planning documents when:

  • Getting married or divorced
  • Having or adopting children
  • Purchasing a home or other significant assets
  • Starting or selling a business
  • Experiencing changes in your financial situation
  • Caring for aging parents or family members
  • Updating beneficiaries or designated decision-makers
  • Preparing for retirement

Even if you already have a will or trust, reviewing your documents periodically can help ensure they continue to reflect your circumstances and wishes.

Frequently Asked Questions About Wills and Trusts

Do I need both a will and a trust?

Not everyone needs both. A will establishes instructions for distributing property and handling certain estate matters, while a trust may provide additional options for managing and distributing assets. The appropriate combination depends on your circumstances and planning goals.

Can a trust help my family avoid probate?

Certain trusts, particularly properly funded revocable living trusts, can allow assets held in the trust to pass to beneficiaries without probate. However, a trust does not automatically eliminate probate for assets that remain outside it.

What happens if I don’t have a will?

If you die without a valid will, state intestacy laws generally determine who inherits property subject to probate. Those rules may not reflect your personal wishes.

What’s the difference between a will and a power of attorney?

A will generally addresses matters after death. A power of attorney authorizes another person to act on your behalf during your lifetime, subject to the document’s terms and applicable law.
